1. Scope and acceptance
- These Terms and Conditions govern access to and use of deefruit.sg and the purchase of products through the DeeFruit online store.
- By accessing the website, creating an account, or placing an order, you agree to these Terms.
- If you do not agree, please do not use the website or place an order.
2. Eligibility and accounts
- You must be at least 18 years old, or otherwise have the consent of a parent or legal guardian, to place an order.
- You are responsible for keeping your account credentials confidential and for all activities carried out under your account.
- You must provide accurate, current, and complete information when placing an order or creating an account.
3. Product information and availability
- We try to ensure that product descriptions, ingredients, images, availability, and pricing are accurate. However, minor variations may occur and website content may contain errors or omissions.
- All products are subject to availability. We may limit quantities, discontinue products, or update product information without prior notice.
- Nothing on the website constitutes a binding offer by us until we accept your order.
4. Prices, GST, and payment
- Prices shown on deefruit.sg are in Singapore dollars unless otherwise stated.
- Prices are inclusive of GST only where expressly stated. If GST is chargeable and not already included, it will be shown at checkout.
- Payment must be successfully authorised before an order is accepted and processed.
- We may use third-party payment service providers. We do not store full payment card details unless expressly stated.
5. Order acceptance and cancellation
- After you place an order, you may receive an acknowledgement email. This only confirms receipt of your order request and does not mean the order has been accepted.
- A contract is formed only when we accept the order and issue a confirmation that the order has been processed or dispatched.
- We may reject, cancel, or limit any order for reasons including stock unavailability, payment issues, suspected fraud, pricing errors, or compliance concerns. If payment has already been captured, we will arrange the appropriate refund.
6. Shipping, delivery, and risk
- Shipping terms, delivery estimates, fees, and service areas are set out in our Order and Shipping Policy.
- Delivery timelines are estimates only and may be affected by peak periods, weather, courier delays, incorrect addresses, failed delivery attempts, or events beyond our reasonable control.
- Risk in the products passes to you upon delivery to the address provided in the order, except to the extent otherwise required by applicable law.
7. Returns, refunds, and remedies
- Our operational returns and refunds process is set out in our Return and Refunds Policy.
- Nothing in these Terms is intended to exclude or restrict any non-excludable rights you may have under Singapore law, including rights under the Consumer Protection (Fair Trading) Act 2003 and any statutory remedies applicable to goods that do not conform to the contract.
- Where a refund is approved, it will usually be made using the original payment method unless otherwise agreed.
8. Promotions, vouchers, and gift items
- Promotions, discount codes, bundle offers, free gifts, and gifts-with-purchase are subject to specific campaign terms.
- Unless otherwise required by law, shipping fees, complimentary items, and free gifts are not redeemable for cash and may not be refundable.
- We may withdraw or amend promotions where there has been misuse, technical error, or stock exhaustion.
9. Intellectual property
- All content on deefruit.sg, including text, graphics, product names, logos, website design, and software, is owned by or licensed to Sainhall Nutrihealth Pte. Ltd. and is protected by applicable intellectual property laws.
- You may not copy, reproduce, republish, distribute, modify, reverse engineer, or commercially exploit website content without our prior written consent, except as permitted by law.
10. User content and reviews
- If you submit reviews, feedback, testimonials, images, or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display that content for customer service, marketing, and operational purposes.
- You must not submit content that is unlawful, defamatory, infringing, misleading, obscene, or otherwise objectionable.
- We may remove or moderate user content at our discretion.
11. Acceptable use
- You must not misuse the website, interfere with its operation, introduce malicious code, attempt unauthorised access, or use the website in breach of applicable laws or regulations.
12. Limitation of liability
- To the maximum extent permitted by Singapore law, DeeFruit will not be liable for indirect, incidental, special, or consequential loss, loss of profit, loss of revenue, or loss of data arising from the use of the website or the purchase of products.
- Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded or limited.
13. Indemnity
- You agree to indemnify and hold DeeFruit harmless against claims, losses, liabilities, and expenses arising from your breach of these Terms or misuse of the website, except to the extent caused by our own negligence or breach.
14. Personal data and marketing
- Our Privacy Policy explains how we collect, use, disclose, and protect personal data in accordance with the Personal Data Protection Act 2012 of Singapore.
- Where we send marketing messages to Singapore telephone numbers, we will do so in accordance with the Personal Data Protection Act 2012, including the Do Not Call provisions where applicable.
15. Governing law and dispute resolution
- These Terms are governed by the laws of Singapore.
- You agree to submit to the non-exclusive jurisdiction of the courts of Singapore, unless applicable law requires otherwise.
16. Changes to these Terms
- We may update these Terms from time to time. The latest version will be posted on deefruit.sg with the revised effective date.
